Terms of Service

These Terms of Service ("Terms") govern your access to and use of CFB Pick 'Em Bot (the "Bot"), a Discord bot for running college football and NFL pick 'em pools. By adding the Bot to a Discord server or using any of its commands, you agree to these Terms on behalf of yourself and, if applicable, the server you administer.

1. The service

The Bot lets a Discord server run one or more weekly pick 'em pools: it posts a board of games, collects picks from server members, scores them, and tracks standings. It relies on publicly available sports data (currently from ESPN) that is not owned or guaranteed by us, and on Discord's platform, which is owned and operated by Discord Inc. and governed by its own Terms of Service.

2. License to use the Bot

The Bot is distributed as source code you (or whoever operates your deployment) run on your own infrastructure. If you purchased a license key, that key grants a personal, non-transferable, non-exclusive license to activate and run one deployment of the Bot, subject to these Terms. You may not resell, sublicense, or redistribute the Bot or your license key without permission.

3. Purchases and refunds

License keys are sold through Gumroad. Payment processing, receipts, and any applicable sales tax are handled entirely by Gumroad under its own terms. Refund requests are handled according to the refund policy stated on the product's Gumroad listing at the time of purchase.

4. Acceptable use

You agree not to use the Bot to violate Discord's Terms of Service or Community Guidelines, to harass or abuse other users, to attempt to disrupt or reverse-engineer the Bot's infrastructure beyond what your license permits, or to use it for any unlawful purpose.

5. No guarantee of accuracy

Game schedules, odds, spreads, scores, and rankings are pulled from third-party sources and may be delayed, incomplete, or incorrect. The Bot is a game for entertainment purposes — it is not a sportsbook, and nothing about it should be relied on for wagering or any decision with financial consequences.

6. Disclaimer of warranties

The Bot is provided "as is" and "as available," without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee the Bot will be uninterrupted, error-free, or available at all times.

7. Limitation of liability

To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, or consequential damages arising from your use of, or inability to use, the Bot — including lost data, lost standings, or disputes between players in a pool. Our total liability for any claim relating to the Bot will not exceed the amount you paid for your license, if any.

8. Termination

We may suspend or discontinue support for the Bot at any time. You may stop using the Bot at any time by removing it from your server. Sections of these Terms that by their nature should survive termination (e.g. limitation of liability) will survive.

9. Changes to these Terms

We may update these Terms from time to time. Continued use of the Bot after a change is posted constitutes acceptance of the updated Terms.
